Dear Mr. Twomey,

We are writing to inform you about recent serious problems with the functioning of
the .UA and .COM.UA domains, and to propose a possible solution.

At 24:00, on October 15, 2004, Hostmaster Ltd, the organization which presently performs
the technical administration functions of the .UA domain, discontinued processing
requests in the .UA and .COM.UA domains. These actions have blocked the functioning of 96
registrars of the .UA domain, and were carried out regardless of the fact that the
majority of the registrars (members of the Ukrainian Internet Association) had signed
contracts offered by Hostmaster Ltd.

Now, the registrars are receiving a stream of complaints from ordinary domain users who
signed contracts with them on delegation and prolongation of .UA domain names.

The Ukrainian Internet Association is deeply concerned with this unsatisfactory situation
and we wish to propose that ICANN enter into negotiations on changing the current
administrator of the .UA domain.

We are aware of the procedure for doing this, as described in the document
entitled "ccTLD Redelegation Step-by-Step Overview", and we are therefore currently in
the process of legalizing the papers for this purpose, as listed in Appendix A to this
document.

We ask ICANN to take the following circumstances into account:

1. According to Item 3, Clause 56 of the Law of Ukraine "On Telecommunications",
administration of the .UA domain should be carried out by a non-governmental organization
which must be set up by self-governing associations of Internet service providers.

2. The Ukrainian Internet Association is a non-governmental organization, formed in 2001,
and unites more than seventy of the largest commercial organizations. Most of them are
Internet service providers and registrars of domain names, which currently cover over 85
percent of the Internet services market in Ukraine.

3. These companies, being members of the Ukrainian Internet Association, have
successfully administered public domains for more than ten years and therefore possess
all the necessary authority and experience in this field. With the documents we are
preparing (Appendix A), you are provided with a list of facts testifying to this
experience.

4. We are prepared to undertake all necessary coordination with state bodies/authorities.

5. We are prepared to conclude a contract with ICANN with the specified conditions for
ccTLD administrators.

Given the current difficult situation, we are confident that our proposal will be taken
into consideration, and are looking forward to your response.

Уважаемый господин Туми,

Мы пишем для того, чтобы проинформировать Вас о недавно возникших серьезных
проблемах в функционировании доменов .UA и .COM.UA и предложить возможное решение.

В 24:00, 15 октября 2004 года ООО "Хостмастер" - организация, осуществляющая в настоящее
время техническое администрирование домена .UA, - прекратила обработку заявок в
доменах .UA и .COM.UA. Эти действия блокируют работу 96 регистраторов домена .UA и были
осуществлены независимо от того факта, что большинство регистраторов (членов ИнАУ) к тому
времени подписали договора, предложенные ООО "Хостмастер".

В настоящее время регистраторы получают поток претензий от рядовых пользователей доменов,
заключивших с ними договора на делегирование и пролонгацию доменных имен в домене .UA.

Интернет Ассоциация Украины глубоко обеспокоена этой неудовлетворительной ситуацией и
предлагает ICANN начать переговоры о смене действующего администратора домена .UA.

Мы знакомы с этой процедурой, описанной в документе "ccTLD Redelegation
Step-by-Step Overview", и в настоящее время согласно этой процедуре оформляем
соответствующие документы, перечисленные в Приложении А.

Просим ICANN принять во внимание следующие обстоятельства:

1. В соответствии с п.3 ст.56 Закона Украины "О телекоммуникациях", администрирование
домена .UA должно осуществляться негосударственной организацией, которая создается
самоуправляемыми организациями операторов и провайдеров Интернет.

2. Интернет Ассоциация Украины является негосударственной организацией, созданной в 2001
году и объединяющей более 70 крупнейших коммерческих организаций. Большинство из них
являются  Интернет сервис-провайдерами и регистраторами доменных имен, контролирующими
совокупно более 85 процентов рынка услуг Интернет в Украине.

3. Эти компании, члены ИнАУ, успешно администрируют публичные домены на протяжении более
чем десяти лет и, соответственно, обладают необходимым авторитетом и опытом в этой сфере.
В документах, которые мы готовим (Приложение A), Вам будет предоставлен список
доказательств, свидетельствующих об этом опыте.

4. Мы готовы провести все необходимые согласования с государственными органами.

5. Мы готовы заключить контракт с ICANN на условиях, действующих в настоящее
время для администраторов ccTLD.

Учитывая сложившуюся сложную ситуацию, мы уверены, что наше предложение
будет принято к рассмотрению. Мы ожидаем Вашего ответа.
